By accessing or using our website, downloading website files, or purchasing services such as hosting, you agree to these Terms.

1. Services Provided

WebXpress provides simple website generation tools and optional website hosting services.

  • Downloaded website files are provided “as is” with no guarantee of ongoing support, updates, SEO ranking, or security maintenance.
  • Hosting services (if purchased) are billed annually and include basic support as described at the time of purchase.

2. Ownership and Use

  • All website files generated through WebXpress are licensed for your personal or business use.
  • You may modify the files as you wish after download.
  • You are responsible for managing and uploading your website to your chosen hosting provider unless you engage WebXpress hosting services separately.

3. Payments and Refunds

  • All prices are stated in USD unless otherwise specified.
  • Payments for website hosting are made in advance for a 12-month term.
  • No refunds are provided once website files are generated or hosting services are activated, except where required by Australian Consumer Law.

4. Limitations of Liability

  • WebXpress and Digital Elements are not responsible for any issues arising from:
    • Incorrect use of the downloaded files
    • Website downtime due to third-party hosting providers
    • Security vulnerabilities if the files are altered or uploaded improperly
  • Our liability is limited to the maximum extent permitted by law.

5. Privacy

Your privacy is important to us.

6. Third-Party Services

We may provide links or connections to third-party websites or services (such as Stripe for payments).
We are not responsible for third-party content, services, or policies.

Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
